BlueTraker Warranty Terms and Conditions

Thank you for your interest in the BlueTraker line of products (hereinafter referred to as BlueTraker), provided by EMA d.o.o., a company duly operating under the laws of Slovenia, with registered office at Teharje 7B, 3000, Celje, Slovenia (hereinafter referred to as EMA).

General Warranty

This Warranty covers any defects in material or workmanship under normal use during the Warranty Period. EMA warrants that its BlueTraker will perform substantially in accordance with the accompanying written materials and that BlueTraker will be free from defects in materials and workmanship under normal use and service for a period of 12 (twelve) months from the date of receipt (Warranty Period).

EMA warrants that BlueTraker devices are new, unused, of the most recent models and incorporate all recent improvements in design and materials. EMA warrants that BlueTraker has no defects arising from design, built-in materials or workmanship.

Warranty Conditions

During the Warranty Period, EMA will repair, using new or refurbished replacement parts, or replace, at no charge, products or parts of a product that proves defective because of improper material or workmanship, under normal use and maintenance. A replaced BlueTraker or part assumes the remaining warranty of the original BlueTraker or 6 (six) months from the date of replacement or repair, whichever is longer.

Warranty Limitations and Exclusions

Warranty is not valid if any of the following acts or conditions result in malfunctioning of the unit or damaging it in any respect:

  1. Improper Installation: Installation that is not carried out in accordance with the provided instructions and guidelines from EMA (installation manuals).
  2. Unauthorized Installation: The installation of the BlueTraker equipment must be performed solely by authorized personnel. Any installation executed by unauthorized individuals will result in the voiding of the warranty.
  3. Non-compliance to BlueTraker User Manual guidelines: Failure to adhere to the guidelines provided in the user manual from EMA.
  4. Improper or Unauthorized Maintenance: Maintenance that is not proper and/or unauthorized, leading to malfunction or damage.
  5. Mechanical Damages: Any physical damage to the BlueTraker equipment.
  6. Electrical Damage: Any damage due to electrical surges, exposure to incorrect voltage or current levels, or reverse power supply polarity will result in warranty termination.
  7. Faults caused by "Force Majeure": Such as power failures, fires, floods, snow, ice, lightning, excessive heat or cold, highly corrosive environments, accidents, actions of third parties.

Warranty is also not valid in cases such as:

  1. Serial Number Alteration: Where the serial number on a product is altered, defaced, or removed.
  2. Product Damage during Delivery: If the product is damaged during the delivery to the end customer.
  3. Unauthorized Opening or Tampering with Transponder: Opening the BlueTraker transponder's lid by unscrewing or tampering with the screws, or tampering with the pressure relief valve in any way—such as removal or damage—for any reason, without explicit written consent from BlueTraker, will void the warranty.
  4. Unauthorized Alteration of Cables and Cable Sets: Tampering with or altering the cables and cable sets supplied with the BlueTraker transponder, including but not limited to cutting the cables to adjust length, without explicit written consent from BlueTraker, will also void the warranty.

The following consumables and equipment are excluded from the warranty:

  1. Second-hand products,
  2. Backup batteries,
  3. External connectors,
  4. Cables and cable sets.

Additional Warranty Notes

EMA warranty applies to the original customer and is not transferrable.

If BlueTraker equipment is specified and described “as used”, unless otherwise agreed in writing by the parties, it is sold “as it is” and with no warranty.

Warranty Procedure

To obtain warranty service, the customer must first obtain a written Return Merchandize Authorization (RMA) from EMA. Once RMA is obtained, the customer is responsible for packing and shipping the product to EMA, within thirty (30) days after receipt of the RMA, in accordance with the RMA Policy.

Any product received by EMA without RMA may be returned to the customer or considered as non-warranty repair.

Non-Warranty Repair

For Non-Warranty Repairs apply Telematics Repair Terms and Conditions, which include Telematics Repair Service Price List.

No other Warranties

To the maximum extent permitted by applicable law, EMA and its suppliers disclaim all other warranties, either expressed or implied, including, but not limited to implied warranties of merchantability and fitness for a particular purpose.

No liability for damages

To the maximum extent permitted by applicable law, in no event shall EMA or its suppliers be liable for any damages whatsoever (including without limitation, special, incidental, consequential, or indirect damages for personal injury, loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use BlueTraker products, even if EMA has been advised of the possibility of such damages. The limitations set forth here will apply even if the remedies of error correction, repair or replacement, reperformance of services and refund of payments completely fail of their essential purpose. Notwithstanding anything herein to the contrary, the limit of EMAs liability (whether in contract, tort, negligence, strict liability, by statute or otherwise) to customer or to any third party concerning the EMA equipment sold to customer and warranted hereunder, EMA performance or nonperformance, or in any manner related to this standard warranty policy statement, for any and all claims, will not in the aggregate exceed the actual amounts received by EMA for the specific product with respect to which such claim is made.
